Who is it about? The Twitch streamer and YouTuber Jasmin Gnu is one of the most successful German content creators. She became known for gaming on her Twitch channel and her main YouTube channel, and she addresses social issues on one of her secondary YouTube channels, Jasmin Gnu.
Recently, she reported in a livestream on Twitch that content is being created about her that she never agreed to. People are making so-called deepfakes in an erotic context of her. This means that the face of the YouTuber is placed on women’s bodies in suggestive videos to imply that Jasmin Gnu is appearing in the video.

Now the Twitch streamer shares how this deepfake material almost limited her professionally as well.

What has it led to? According to Jasmin Gnu, this material is now so present on the internet that it affects her work. According to her, it almost led her to lose this job at an event. The event was very important to her.
While researching about Jasmin Gnu, the organizers apparently found so much pornographic deepfake material that they thought the YouTuber was an erotic performer. As a result, they wanted to disinvite her. However, a colleague was eventually able to clarify the misunderstanding and vouch for the influencer.

This also shows again that alongside the very, very serious physical, virtual abuse, there can also be such consequences. I find it so absurd that it has taken so many years, and we are still discussing the fact that when I, as a woman, decide not to undress, this decision is taken away from me. […]

In this context, Jasmin Gnu demands stricter German laws that adequately punish the creation of such deepfake content without consent.
What is the legal situation? However, ensuring the creation of such deepfakes in Germany is treated under current laws proves to be very difficult. There are no specific German laws that penalize the creation of deepfakes (source: bundestag.de).
The Tagesschau reflects the assessment of criminal law specialist Udo Vetter: He believes that the stalking paragraph
(§ 238 StGB) could apply here. According to this, it is punishable to publish content about another person that belittles that person.
As Tagesschau also reports, public pressure on the current legal situation regarding digital violence has increased, leading to a legislative proposal. It remains to be seen how the legal situation will develop.
