Do you know the site Kickstarter? Through this American internet platform, creative minds who lack the necessary funds to finance their dreams can collect donations. It does not necessarily have to be about MMOs; all possibilities are open. Everything has been included, from music albums to nutrition projects.
The condition is: promises must be kept. In the past, there have been recurring problems, but so far the legal situation has been somewhat vague. What was clear, however, is that those who do not complete their projects will not receive donations. But what happens when the project is completed, but some aspects are not met?
In the case of Ed Nash and his company Altius Management, it was about missing rewards for the supporters. Instead of the targeted $15,000, a whopping $25,146 was raised. As a thank you, the developers of the online card game Asylum promised the donors exclusive card decks and artworks with autographs – but did not keep their promise.
But Washington State Attorney General Bob Ferguson took up the matter and is now suing Ed Nash and his company for damages and the assumption of legal costs.
Consumers need to be aware that crowdfunding is not without risks. This lawsuit is meant to send a clear message to everyone who asks the public for money: The state of Washington does not tolerate theft via crowdfunding. The Attorney General’s office will sue those responsible who do not play by the rules.
The outcome of the proceedings is still open, but we can be curious – as this would clearly be a precedent in matters of Kickstarter.
