Does it actually violate Twitch’s guidelines? Yes, it does. Under the section “Content Labeling,” it points out that intentional and extensive abuse of titles, tags, or games/categories is prohibited (via Twitch.tv). However, there have not been any consequences for the streamers so far.
What are additional problems with improper tag usage? Besides the problem that users do not find the desired content, smaller streams are further pushed down. It is already difficult to be discovered on Twitch when larger streams are at the front.
All those who use the VTuber tag are pushing out the real VTubers, making it harder for them to be found. Some also speak of the improper labeling being disrespectful.
