Our terms of use govern the free, ad-supported use of our platform.

§ 1 Essential changes to the previous version

(1) List of changes:

  • Numerous minor changes such as corrected typos, standardization of spellings and formulations also with other documents from us, as well as improvements in comprehensibility and clarity, for example, through a table of contents
  • Adjustment of the section regarding community content and rules to the current legal situation

§ 2 Scope

(1) Website and Community: The following terms of use apply to the entire present Internet platform www.mein-mmo.de, maintained by Webedia GmbH, Cuvrystraße 3 – 4, 10997 Berlin, represented by the managing director Marc-Andreas Albert, and govern the use of the services we offer (including but not limited to the provision of texts, videos, images, and downloads) including functionalities for user exchange among themselves and with the editorial staff via comment functions, forums, user profile pages, as well as the content uploaded by users of any kind (including but not limited to texts and images).

§ 3 Fair Use

(1) Free use without ad blockers: The free version of our Internet platform is financed through the display of advertisements in the form of banners, video advertisements, sponsored content, as well as affiliate links and other advertising placements. We reserve the right to block certain features, specific or all content, or access to the entire platform if this agreement regarding the fair use of the platform is unilaterally violated, for example by using so-called ad blockers. Regardless, we do not assume any guarantee or liability for the proper functioning of the platform when ad blockers are used, as such programs may interfere deeply with its functionality and potentially impair it.

§ 4 User Accounts

(1) Free registration: For some features of the platform, especially for uploading content or for interaction with other users, you need a free, overarching user account for this Internet platform. Registration requires at least a username, a password, and a valid email address. Multiple registrations or registration with false or third-party information is expressly prohibited.

(2) Truthful information: User who violates our general terms of use may be admonished, warned, or temporarily or permanently excluded from the community or lose writing rights depending on the individual case according to § 5 Community Content and Rules. This also applies to the creation or use of more than one user account.

(3) Deleting the account: Termination of this agreement is possible at any time and immediately for free user accounts through the respective user’s control center. Webedia will then delete all personal data, including usernames, any registered real names, email addresses, addresses, etc.; any created user content will be deleted or anonymized. Restoration of the user account is not possible; the username will be available for use by new users immediately after account deletion.

§ 5 Community Content and Rules

(1) Assurance and guarantees regarding user content: You are solely responsible for your user content and the consequences that arise from posting or publishing this content. You declare and guarantee that

  1. you are the creator or hold all rights to your user content or otherwise have sufficient rights and powers to grant the rights granted herein;
  2. your user content (a) does not infringe or unlawfully claim the rights of third parties, including copyrights, trademark rights, trade secrets, personal rights, publication rights, patents, or other intellectual property or ownership rights, or (b) does not insult other persons;
  3. your content does not contain dangerous or harmful codes; and
  4. your user content does not contain confidential information from Webedia or third parties, unless you have received prior written permission.

(2) Peaceful coexistence without legal violations: The following rules apply to all users of our platform:

  1. The laws of the Federal Republic of Germany must be observed. Violations may lead to criminal prosecution.
  2. No contracts, intellectual properties, or other rights of third parties may be violated and no illegal acts committed.
  3. Politically radical statements, insults, slurs, disinformation, toxic behavior, and deliberately poisoning the discussion climate are not allowed; accordingly, such content will neither be created, uploaded, transmitted, distributed, nor stored.
  4. Uploading, transmitting, distributing, soliciting, promoting, advertising, and linking to copyrighted content for illegal purposes is prohibited.
  5. Uploading, transmitting, distributing, storing, depicting, promoting, and linking to weapons, drugs, and pornography is prohibited.
  6. Mass creation, uploading, or distribution of meaningless, offensive, defamatory, or otherwise inappropriate content harmful to peaceful coexistence is prohibited.

(3) Review of reported content and decision-making:

  1. All reported content will be reviewed by humans. In addition, we use AI tools when checking new user content and employ automated methods for bot and spam detection. Active moderation by artificial intelligence does not take place.
  2. In the unrecorded or unclear individual case, we decide based on the facts at hand. In all situations, the ultimate decision-making authority rests with us.
  3. In principle, moderation decisions will not be publicly discussed. We will only remove, review, or edit content for valid reasons, especially if such content violates these general terms of use or applicable law. We decide between hiding the comment, verbal admonition, a stored warning in the system, as well as the temporary or permanent withdrawal of writing rights. Users will also be notified via email regarding warnings and the withdrawal of writing rights unless this is deemed inappropriate or legally prohibited considering the specific circumstances of the individual case.   4. The statutory transparency report regarding our moderation activities is always up-to-date.

(4) Consequences of misconduct:

  1. Violation of German laws may lead to criminal prosecution. Depending on the individual case, we actively report certain incidents and provide all available information including any personal data to the relevant authorities in accordance with our privacy policy.
  2. Those who violate our rules may be admonished, warned, or temporarily or permanently excluded from the community or lose writing rights depending on the individual case. You will be informed of this via email.

§ 6 Involved Companies (Third Parties)

(1) High standards for and contracts with third parties: We work with various companies to offer certain functions of the platform or complementary products. In selecting partners, we set high standards, for example with regard to data protection, including data storage according to European and German data protection law, as far as the operation of these functions or products requires the storage of personal data at all.

  1. Depending on the partner offer, an additional user account may be required, possibly also the provision of personal data such as name, address, and payment information. In this case, you enter into a direct contract with the respective partner company at your own request, not with us.
  2. Payment obligations arise only if you intentionally order certain products or services from these involved partner companies for a fee. The benefits, vouchers, and discounts offered by involved partner companies cannot be combined with other vouchers unless otherwise stated. The respective general terms and conditions of the respective company apply, which will be separately pointed out at the time of ordering.
  3. When we integrate or promote offers from third parties, we strive to accurately display the current prices. However, we cannot guarantee the actual prices in external third-party shops. If an external shop repeatedly violates the requirement for clear price labeling, we will pursue corresponding notices firmly and may initiate legal action and/or review cooperation with this third party.
  4. We also accept no liability or warranty for such agreements made with third parties and do not explicitly or implicitly give any assurance or guarantee, in particular that the services offered remain unchanged or are not suspended or discontinued.
  5. Under no circumstances do we pass on any personal data that you may have stored with us to the involved companies unless something else is regulated in our privacy policy. However, your further surfing behavior outside of our platform may be tracked by the respective provider through cookies or similar technical means.

(2) Advertising: The free version of our platform is financed, among other things, through the display of advertising banners delivered by various service providers. We strive to ensure that no objectionable, sexist, racist, or misleading advertising messages are delivered. If you ever encounter problematic advertising from third parties, please inform us by email at [email protected] including a screenshot and the target link of the respective advertising placement (right-click on the respective advertisement and “Copy link”). We will then review the matter and take action if necessary.

§ 7 Raffles

(1) Organizer: The organizer of all raffles conducted on our platform is Webedia GmbH, Cuvrystraße 3 – 4, 10997 Berlin, represented by the managing director Marc-Andreas Albert, unless otherwise stated.

(2) Participation Conditions: Participation is free of charge and independent of the purchase of goods or services. By participating in the raffle, you accept the participation conditions contained in this section § 7. Additional or deviating provisions are indicated on the respective raffle page and apply additionally. Webedia GmbH also reserves the right to change these participation conditions at any time without prior notice. The legal process is excluded.

(3) Participation Exclusion: Employees of Webedia GmbH and affiliated companies, participating companies, as well as relatives of the respective employees are excluded from participation. Participants in the raffle are the natural person who owns the email address provided during registration for the raffle. The minimum age for valid participation is 18 years. Only one participation per natural person is allowed. We reserve the right to exclude participants from participating in raffles even without stating reasons if they culpably violate the participation conditions or attempt to influence the raffle in an unfair manner. This particularly applies in cases of disturbance, threats, and harassment of employees or other participants.

(4) Notification of Winners: The notification of winners takes place within 14 days after the drawing via email using the information provided at registration. Participants are responsible for the accuracy and completeness of their information. By participating in the raffle, you agree that your name will be published in pseudonymous form (e.g., First Name N. from C.) on the respective raffle page. 

(5) Prize Distribution, Change, and Loss: Cash payment, payment in kind, exchange of prizes, or transfer of prizes to third parties is excluded. Prize distribution takes place – depending on the respective raffle – possibly subject to age verification. The winner accepts any necessary changes to the prize. The winner forfeits their prize if they do not provide any additional information necessary for the provision of the prize within six weeks after our contact.

(6) Customs Fees Switzerland: Participants from Switzerland will be informed in advance and additionally in the event of a win that customs fees may apply upon delivery of the prize, which we cannot cover. If the winner refuses to cover the customs fees, a new winner will be drawn.

(7) Data Protection: The data you provide will be processed and used solely for the purposes of this raffle electronically, in accordance with the General Data Protection Regulation (GDPR) and the Federal Data Protection Act (BDSG-new) and any other applicable laws and provisions. Our privacy policy applies. Sharing with third parties occurs only as far as necessary for processing the raffle and verifying the prize. Participants expressly agree to this.

§ 8 Youth Protection

(1) Only from 18: We respect and support youth protection and are therefore a member of the Entertainment Software Self-Regulation (also known as “USK”). Certain content within our internet platform is subject to youth protection laws and is not suitable for young people or minors.

(2) Tool for Guardians: To restrict or block access to our platform for young people, guardians can install and configure the state-recognized youth protection program JusProg according to § 11 JMStV, which is supported by our platform.

§ 9 Data Protection

(1) See Privacy Policy: We take the protection of personal data very seriously and will only use it in accordance with the legal regulations of the Federal Data Protection Act, the General Data Protection Regulation (GDPR), the Telecommunications-Telemedia Data Protection Act (TTDSG), and the Digital Services Act (DSA), and, if applicable, other applicable laws and provisions, and also ensure compliance with data protection regulations with partners. Details on how we handle personal data are explained in our privacy policy.

§ 10 Liability

(1) Limitation of Liability:  If you incur damage through the use of our platforms, we are only liable in cases of intent and gross negligence according to the statutory provisions. In cases of simple negligence, we are liable only if it involves the violation of an essential contractual obligation. In this case, liability is limited to the foreseeable, typical contractual damage.

An essential contractual obligation is an obligation whose fulfillment enables the proper execution of a contract, is decisive for achieving the contractual purpose, and upon whose compliance the other party may regularly rely.

Claims for damages under the Product Liability Act as well as in the event of injury to life, body, or health remain unaffected by the above limitations of liability. The above limitations of liability also apply in favor of our legal representatives, employees, and vicarious agents.

§ 11 Final Provisions

(1) Changes to the platform: This Internet platform is continuously developed and improved. Therefore, contrary to the original scope of services, changes – generally – may occur. Even if our platform is accessible via the Internet, not all functions may be available worldwide for legal, licensing, or other reasons.

(2) Force Majeure: We operate our platforms to the best of our knowledge and belief, but cannot guarantee technically flawless operation. Transmission errors, necessary maintenance windows, or force majeure may temporarily suspend the platform or the availability of the platform.

(3) Applicable Law: The law of the Federal Republic of Germany applies to all legal disputes arising from the agreements made with us, excluding the UN Sales Law.

(4) Jurisdiction: In business transactions with consumers within the European Union, the law at the consumer’s residence may also be applicable, provided it involves mandatory consumer law provisions. If both parties are merchants, legal entities under public law, or special funds under public law, or if you do not have a general jurisdiction at your domicile, Berlin is the exclusive jurisdiction for all disputes arising from the contractual relationship. In other respects, the statutory places of jurisdiction apply.

(5) Invalid Provisions: Should individual provisions of these terms of use be invalid or contradict statutory provisions, the other provisions shall remain unaffected. In place of the invalid provision, the effective regulation that comes closest to the economic purpose of the invalid provision shall apply.

(7) Dispute Resolution: The European Commission provides a platform for online dispute resolution (ODR). The platform can be found at http://ec.europa.eu/consumers/odr. However, we currently do not participate in dispute resolution procedures before a consumer arbitration board – we would rather find direct and unbureaucratic solutions with you.
