When Marcel “MontanaBlack” Eris (36) streams on Twitch, tens of thousands of fans tune in. Recently, the streamer has been spending more time outdoors, but some people feel disturbed by being presented to such a large audience.
What trouble does MontanaBlack have with the DB? The Twitch streamer has increasingly focused on IRL content since 2022, exchanging his well-known streaming room for the “real world”. This can lead to people in the background of the stream appearing who do not want to be shown.
MontanaBlack previously had legal issues due to an IRL stream. In that case, however, an out-of-court settlement was reached. In March 2024, the streamer encountered trouble with employees of the Deutsche Bahn. The train attendants informed him during an IRL stream that he could not take his bicycle on the S-Bahn during restricted times.
Shortly thereafter, a complaint was filed by the DB employees, as they were clearly visible in the stream. However, MontanaBlack does not accept this and accuses the employees of trying to make quick money off him.
MontanaBlack does not want to set a precedent
What does the streamer say? In his IRL stream from April 28, MontanaBlack provided an update on the complaint against him. The streamer finds the demand “disproportionate” and wants to take it to court. The incident in the wildlife park was different, as a small child was also visible there.
MontanaBlack clarifies that people certainly have the right to complain if they appear in his stream against their will. However, he does not want people to make “quick money” at his expense. The DB employees’ demand concerns “a lot of money”. The streamer does not specify an exact amount, but it is more than 1,000 euros.
The 36-year-old believes there must be a proportionality, no matter how much he earns.
MontanaBlack does not expect great chances in court: he will not win the case. After all, it concerns personality rights. However, the streamer hopes for “a reasonable legal system.”
No judge could support that people demand six months’ salary just because they are seen for a few seconds in the stream, MontanaBlack says. He fears that he will set a precedent if he agrees out of court to pay an amount like 10,000 euros. “Then anyone can make easy money,” the streamer remarks.
Why does MontanaBlack believe he is in the right? The 36-year-old clearly distinguishes between people who are accidentally seen in the background of his streams and those who are filmed intentionally. He states that he would never “put a camera in someone’s face and ask stupid questions.”
However, people who appear as mere “props” in his streams do not have the right to sue him. If someone feels disturbed, the streamer is also okay with paying a fine.
However, if “the state” were to condemn him to pay 10,000 to 20,000 euros just because someone is seen for 5 seconds in the stream, he explains, he would no longer be able to make IRL streams in the future.
