Nintendo is taking legal action against a gamer. This gamer is alleged to have provoked the company even in a letter.
What is this lawsuit about? Nintendo is suing the content creator “EveryGameGuru” and demanding up to 7 million euros ($7.5 million) in damages from him. According to the lawsuit, “EveryGameGuru” streamed pirated Nintendo games on various platforms. He used emulators like Yuzu and Rujinx for this.
However, according to Nintendo, he did not limit himself to playing pirated games but also showed his viewers how they too could pirate Nintendo games and play them using emulators. For this, he provided links to pirated copies and the emulators, for example.
Nintendo additionally accuses the content creator of having showcased games such as “The Legends of Zelda: Echoes of Wisdom” and “Paper Mario: The Thousand-Year Door” before their release.
Gamer may have provoked Nintendo
How did he confront Nintendo? According to Nintendo, “EveryGameGuru” did not simply “play, showcase, and distribute” games illegally. No, he really confronted them, the lawsuit states.
It is alleged that the content creator wrote a letter to Nintendo on October 24, 2024, after several platforms removed his VoDs following Nintendo’s “enforcement actions.” In that letter, he supposedly stated according to Nintendo’s lawsuit that he “owns thousands of temporary channels.” Additionally, the lawsuit quotes: “Can do this all day.”
The online magazine Dexerto also reports that “EveryGameGuru” said something like: “You can try to stop me, but I will keep going.”
Copyright infringement in 50 cases
How does the amount come about? The lawsuit states that “EveryGameGuru” has “unauthorized streamed at least ten of Nintendo’s leaked games before their release” since early 2020 – he is alleged to have done this a total of 50 times.
Nintendo says that as a result of the infringements they accuse the streamer of, they are entitled to the maximum legal damages of $150,000 for each copyrighted work.
It is currently unclear whether the content creator is alleged to have unauthorized streamed 50 different games or whether he, according to Nintendo, streamed one game unauthorized 50 times. The former would mean that Nintendo demands $150,000 damages from him 50 times. That totals $7.5 million, or nearly 7 million euros.
