Bungie is actively fighting against cheat makers and dragging them to court if necessary. One of the largest providers, “AimJunkies,” sought to challenge the ruling, but their appeal was denied. Destiny 2 is once again free of cheats.
What was this legal dispute about? AimJunkies, one of the largest cheat providers for Destiny 2, was dragged to court by Bungie. They are accused of selling various software, such as aimbots, to guardians.
For quite some time, the loot shooter has been struggling with cheaters on PC, and consoles are also affected by hardware cheats. Bungie wants to create a safe environment where honestly playing guardians are not disturbed by cheaters.
The proceedings looked good for Bungie; they managed to win the favor of the jury, but the cheat provider filed an appeal. The company wanted to contest the ruling, but they had no chance.
Over 3 million euros in fines – Appeal denied
How did Bungie win? The judgment with a fine of 4.4 million dollars was already established. Bungie had won, but AimJunkies disagreed with the ruling. They filed an appeal.
The reasoning: Bungie could not prove that AimJunkies had violated copyright. The jury supposedly made an incorrect decision, and thus the cheat provider insisted on a new trial or a different penalty.
As a precedent, the defense of AimJunkies used the case of Galoob Toys and Nintendo. There, the software acted as a supporting means to manipulate game files – like a kind of tool.
According to statements from the court, however, the software from AimJunkies was not “dumb and worked more than just a window in the programming of Destiny 2.” With it, players were able to modify the code of Destiny 2 and adjust values, thus gaining unfair advantages.
The result: The appeal was denied, and claims that the court had disregarded crucial evidence in the process were dismissed. If one now calculates the fine that AimJunkies would have to pay Bungie, and takes into account the price of The Final Shape (since Destiny 2 is free), Bungie would have sold DLC equivalent to 79,621 times.
